Interestingly this type of litigation is initiated by the court. The court system is responsible for initiating this legal proceeding. Although many view it as a rel atively new type of litigation, it has featured prominently in environmental law practice. Any action taken by an individual or by a corporation that results in inhibiting a particular society’s progress or damages a necessity is punishable under this type of litigation. Public Interest Litigation is an attempt to fulfill the guarantee of fundamental rights that citizens have been guaranteed (Kirpal, et al, 2000). In certain cases that involve injury to persons, legal processes may be initiated in order to realize the dispute. These legal proceedings are referred to as Personal Injury Litigations. In a typical case, an individual filing for this type of a case seeks to be compensated for injuries. This type of litigation arises from the deliberate or negligent action by a given party that precipitates to the physical injury of another party. Many clients are advised to seek the advice of the PIAB (Personal Injuries Assessment Board) as a first step towards seeking compensatio n. The PIAB provides an assessment for victims of personal injury and are seeking compensation. It assesses victims of injury at the workplace, public liability accidents and motor accidents (Malcomson Law, 2008). Mesothelioma litigations are common litigations that focus on companies that expose their employees to asbestos without protecting them against it or without even warning them.

CD for Holden Essay Example for Free

CD for Holden Essay How have you been? I have actually missed you a lot. The other day, I took a road trip with my parents and I thought of you. I remembered how you told me you wanted me to burn a CD with music for you. Thus, I listened to my iPod the whole way and selected many cool songs that I think you would like. Please get back to me and tell me which ones you liked and all. Also, I know you told me to only put around 10 songs but I could not contain myself and I chose 16 of them. I hope you will like them, because to tell you the truth all of these songs kill me. The first song I chose to put in the CD is 3 Cigarettes by The Sleeping. Besides the beat and instruments that are cool as hell, the lyrics really remind me of you. First of all, there are the obvious connections to cigarettes, which seem to be one of your passions. Also when he says I have been drinking more and eating less reminds me of you. It is pretty much all that you have done lately, smoked, drank, and thought of Jane. Just remember that just like they say we dont have to blame ourselves you should not blame yourself for everything that has been happening. Finally, the line Do you care? Are you there? Are you listening? kills me and I am sure it will kill you too. It is calling for peoples attentions, it is calling all those phonies and it makes me wonder if anyone really cares about me. I am sure it will make you feel the same way too. The next song I chose was Through the Glass by Stone Sour. I think that this song is talking about an insider who became a stranger and now they are looking from the outside back in. This makes me think of you because many times throughout your life you have alienated yourself. You just look from the outside as time passes by and sometimes you feel like going back in, and being an insider again but you dont. The phrase Im looking at you through the glass; dont know how much time is passed. Oh God it feels like forever makes me think of you a lot. Because you are always thinking about how quickly time passes by. It seems like you have been alienating yourself for a long time now, it feels like forever. The next song on your CD is Tears in Heaven by Eric Clapton. I just had to add this one. I know that you are really sensitive about your brothers death and all, and you dont like talking about it. However, I think that the sooner you face reality the better it will be for you and everyone. This song was made for his son who died. He was very meaningful to Eric Clapton just like your brother Allie was to you. I know you so well, that I am sure that you have wondered about many of the things that this song is stressing about. Such as if Allie would remember your name, and if it would all be the same. Also, there is a bigger picture to it. I remember about an specific conversation with your sister Phoebe you told me about. She asked you to name one thing you really liked and you said you really liked Allie. I think you should listen to lines such as Cause I know I dont belong here in heaven and Cause I know I just cant stay here in heaven. The bigger picture that these lines are showing and I am trying to prove to you is that as much as you love Allie you have to let him go. You are both in different worlds now, and wherever he is, you dont belong there. At least not yet. Holden, you should really get on with your life and just keep with you all of the good memories you have with Allie but let him go. It is the best thing to do. I am sure you will enjoy quite a lot the next song I picked out for you. It is a classic by the great band Pink Floyd. This one is called Another Brick in the Wall. You might have heard of it already. The meaning of the song is to say that in school they treat us all the same and they do not respect that everyone is a separate and different individual. Pink Floyd is saying that this is all false control and they are putting all the students together and trying to make them all the same, therefore losing their individualities. I can tell that you will agree with these lines, and that they will really kill you. When they say All in all its just another brick in the wall, the meaning is that every single one of us students are just a tiny brick of the wall of hypocrisy, superficiality, and shallowness that they are trying to build. They are the ones that you every so often refer to as the phonies. That is what I think this song is criticizing, phonies who try to make everyone be the same. They try to make everyone be like them. Hopefully there are still people out there, like me and you, who are going to fight this and knock down this wall of phonies. The next song I picked is called Boys Dont Cry by The Cure. It makes me think of you and Jane. When I listen to it, I think of how you like Jane so much and she is the only girl that you truly care about but you wont tell her. Just like the song is describing, you often say I would You mention things that you would do, such as give her a buzz, and visit her, and ask her on a date. However, you never do any of it. The line boys dont cry is obviously making a critic to some boys like you, who would rather hide their feelings and appearing tough instead of telling the truth and possibly crying. I love the line I try and laugh about it hiding the tears in my eyes and the one I try to laugh about it; cover it all up with lies. Both of these lines are very strong. They also show things that you do. You often act all nonchalant and like giving Jane a buzz is just something you would do any day. However, I think it is much deeper than that. You are scared of being rejected by her because she is the only one you care about. So, you just act casual and cool about it and lie and hide your feels for her. The next song, The Permanent Rain by The Dangerous Summer follows the same line as the one before. I think that just like the singer is saying, I wont let this die, you shouldnt let what you have with Jane die. You and her both have a really strong connection and bond. I think it would be very sad if you did not do anything about it. I think you should go and tell her how you feel. It is really the best thing to do. When he says, I know its not helping to hear me say: I wish it was me in the car the other day really makes me think of you as well. Even though you have never actually told her about it, you have wondered for a long time about her and Stradlater in his teachers car. You wonder about what happened and you cannot help but wish that it were you with her in the car instead of Stradlater. Finally, when the line You know it meant a lot, but I was just a kid comes up it seems like it was written for you. You were both too young to fully understand the connection that you both h ad. Now, I think you are old and mature enough to understand it and your relationship with Jane should mean even more if you tell her how you feel. The next song, however, is not about Jane. It is about High School, hence the name High School Low by Say Anything. Just like you, the guy in the song is sixteen. He is also worrying about things such as the whole high school experience, and girls. I find there is even a connection to you when he says, My teacher says that Im brilliant. It reminds me of how Mr. Spencer would try and get the best out of you. He did not say you were brilliant, however, he acknowledge that you had so much more potential than the one you were showing with your poor grades and test scores. The passage about looking at pictures of himself when he was a child can also be compared to you. I know that you have often thought about how it is such a horrible experience having to grow up and all, but we will get to this topic later. To do with the whole grades issue, he also says My grades look pretty damn low. I want to motivate myself, but how the hell am I supposed to work. This is something that is so similar to you that it could have come out of your mouth. At the same time that you realize that your grades are low and you need to make an effort, you dont know how to. You are confused about what you should do that would motivate yourself. I remember you told me that when your psychoanalyst asked you if you would apply yourself when you got back to school in September you said you did not know. I mean of course you want to, but as you said it yourself, you are not able to tell how you are going to behave. One phrase that is constantly repeated is take me away. Just like you, this boy wants to run away from these high school days and from all the phoniness and move on to a better part of life; be it the past or the future. Speaking of phonies, this is what my next chosen song is about. It is called Mutiny! by Set Your Goals. This song is clearly criticizing people. In my opinion, it is criticizing the phonies. What leads me to think this way is when things such as superior, you are inferior and heroes have betrayed are said. This is talking about people who think that they are better than other s when they really are nothing special. It is also talking about how people can just betray you and change all of the sudden. Finally, the line I will find the line and cross it every time reminds me of you. It reminds me of how you many times alienate yourself as a form of protection. Therefore, I think that crossing the line is a symbol for you of that crazy red hunting hat you wear. You wear it to prove your point and to show people that you dont care and youre fine with being different. This is nothing else but a way of crossing the line. The next song I chose is called Flake and it is by Jack Johnson. In case you dont know, a flake is someone who says that they will go somewhere or do something and then they dont. Am I the only one who sees a resemblance here to you?! Yes, I am going to start talking about Jane again. You seriously have to stop saying that you will call her, unless you are actually planning on doing it. Otherwise, you are just flaking. The strong line It seems to me that maybe pretty much always means no is what I feel sometimes when you start talking to me about her. You say that you might call her if you feel like it. Now, I am starting to see it as something you just have to say to feel good about yourself, to show that you have the power to call her. I think you should not flake Jane. Besides that, it is a great song and I really love the instrumental and the beat for it. I am sure you will love it too! The next song I picked is a slow one. I find it truly beautiful. It is called Cannonball by Damien Rice. It is also a love song. What I think it is talking about is about someone whom he really loves but that he cannot be with for a reason or another. He talks about how he remembers the girl all the time, and the things that remind him of her. I think that the way he feels about this girl is just like how you feel about Jane. It reminds me of how you remember her because of little things such as how she always kept her kings on the back. This song also brings up the issue you have of lying and it claims that the issues he had to face in life when dealing with love are the ones that made him be like that. It also reminds me of you when he mentions that It is not hard to fall when you float like a cannonball because you can often be very heavy and therefore you sink into your issues like a cannonball sinking down in an ocean. My favorite like on this song, however, has to be the last one. It says when you know that you just dont know. I think it is talking about when people are confused and how it takes courage, to even admit that you are lost. Speed of Sound by Coldplay is also sort of a slow song. The main point to this song is that it is talking about time. I think that Coldplay is trying to show how everything moves so fast, like the speed of sound. Time goes by too quickly, Holden. I know you have already realized that before, considering how you have told me countless times and made me notice that once we notice everything has already happened. This song could have been sung by someone who is waiting on a platform and they are noticing how fast things happen. It also talks about the issues we all have with dealing with this fast-moving time. Be prepared because this next song I am about to introduce to you will kill you. I am serious. It is called Forever Young and it is by Alphaville. It is impossible for me to listen to it and not think of you. The main point to this song is the fact that we all get old. The singer obviously wants to be forever young just like you! You tend to resist the natural process of maturity and growing up. It seems like you want to be forever young without having any responsibilities or having to deal with any problems of adulthood. I think this is mostly because you are scared. You are scared of what awaits for you, and it all sort of mystify you. That is why you invent that you do not want to be an adult because it is a world of phoniness. It is your way of running away from the fact that you are actually scared of growing up because you do not have a clue of what any of it is like. A line on this song that I find really interesting is Some are like water, some are like the heat, some are a melody and some are the beat. I think that this line is talking about the people that make our life what it is. The people that are there for us. I think that water is a symbol for the people that are a bit colder and the heat for the ones who are warm. The people who are a melody are the ones, like Jane, who come every once in a while and they completely change how you were before, just like the melody of a song. The melodies of someones life are not always there, but we can never be the same after they leave. Finally, the beat is a symbol for the people who are there to support you in your life constantly, just like the beat in a song. It is also impossible to be the same without the beats of our life, such as Phoebe, because they are the ones that we can call whenever we need. I think you will really enjoy the next song I picked. It is called Marching Bands of Manhattan by Death Cab for Cutie. First of all, the main reason of why it reminds me of you is the whole New York experience. I know how much that city describes you. I am sorry but I will have to bring old Jane up once again. I think that this song is mostly talking about how he wants to be with someone that doesnt know how they feel. I think that this is your type of song, and I hope you will like it. If you like it, you should look up more songs by Death Cab for Cutie, they all send like this and have wonderful lyrics. Well, this is pretty much all, I hope you enjoyed the songs I chose and you will take some of the advice I gave you. Remember to get back to me and tell me what you thought of them. Oh! The Role of the Catholic Church In The New World The Catholic Church during the Middle Ages played an all encompassing role over the lives of the people and the government. As the Dark Ages came to a close the ideas of the Renaissance started to take hold, and the church's power gradually began to wain. The monarchies of Europe also began to grow, replacing the church's power. Monarchies, at the close of the Middle Ages and the dawn of the Renaissance, did not so much seek the guidance of the church as much as it sought their approval. However, the Church during the Age of Discovery was still a major influence. The discovery of the New World and its previously unknown inhabitants presented new problems in the Catholic Church in the late 14th and early 15th century. When Spain's rulers and emissaries decided to physically conquer and populate the New World, and not just trade with it, the transplantation of Christian institutions followed. The church established contact with the New World, and made it a goal to establish the Catholic doctrines among the native population there. The Catholic Church and the Spanish monarch, however, looked upon the native population in the New World as souls to be saved. They did not consider or treat the Indians as equals. The implanting of Christianity in the New World, and the treatment of the native population by the missionaries and christian conquerors was detrimental to New World. Through men such as Cortez and Las Casas accounts of the conversions have been recorded. One of the reasons for this was the alliance of the Catholic Church with the Spanish monarchy. The status of the Indians was disregarded as the Christian conquers and missionaries who wanted to convert them subjected the... ...d to work toward goals that they did not fully understand. Through the writings of Las Casas, it is seen how the Indians were slaughtered needlessly, and how they were baptised without regard to their feelings. Cortez paved the way for missions to be founded in the New World supposedly for the good of the Indian population. This, however, also turned against them. Microeconomics and the Laws of Supply and Demand Essay

Macroeconomics focuses on the entire economy while micro economics studies the individual characteristics and peoples within the economy. Both the fourth and seventh scenarios in the simulation were examples of macroeconomics. They illustrated examples that display the economy as a whole. For example, the affected changes were caused by an increase in the population and a change in consumer demand. The first and second scenarios were examples of microeconomics as they illustrated actions and decisions of individuals and businesses. Whenever the managers created lower or higher price points for rentals they affected the supply and demand curves. As the summary at the end of the simulation states, â€Å"the supply and demand curve is not static; various factors cause them to increase or decrease.† For instance, in the simulation there was a shift in the demand curve with changes in the rental rates for the apartments. The supply curve shifted downward as the demand shifted upward with the changes in lower rental rates. More specifically, when the rental rates lowered to $1050 consumers began demanding more apartments at that rate. The increase in demand led to lower vacancies and, thus, less supply The equilibrium price is the price that allows the supply to meet the exact quantity of what is demanded. When there is shortage in the market it put pressure on the price and increases the price. When there is a surplus in the market it exerts a downward pressure on the price and decreases and decreases the price. Surplus and shortage determines the rate of equilibrium. Applying what we learned Working for a tea supplier for the Los Angeles County and Orange County, the lessons in the simulation really resonated with me. I started to think about the effects of pricing on our products and its effect on the supply and demand for our specific products. I began thinking about what factors are necessary to meet the demands of our clientele without compromising positive revenues. By analyzing our current conditions and creating accurate supply and demand curves for our products I realized that our company can set prices at equilibrium. In the context of microeconomics, individual and business decisions are what create shifts in supply and demand on the equilibrium price and quantity. For example, when the managers for the apartments made decisions to have lower vacancies they had to lower the price on there month to month rentals. This increased the demand while lowering the supply thereby creating a price that is closer to equilibrium. In the context of macroeconomics, population changes or things like unemployment rates would change the supply and demand. For example, when the unemployment rate is high there would be less demand for higher priced rental rates. This would, therefore, increase the supply. In other words, there would be a surplus in vacant apartments. With a higher population rate there would be an increase in demand. There is a direct relationship between the prices of a product set by a firm to how much it will be demanded by the consumers. The price elasticity refers to these changes in demand as the price is lowered or raised. Therefore, the most essential question firms must ask first when determining a price points is, â€Å"How many people will demand a certain product at what specific price?† This does not take into consideration the supply held by a firm since it makes no difference to what is demanded based on the price. The business world nowadays is very different from the past. It is fast changing, challenging and full of opportunities. In order to sustain the business, the companies need to minimize costs, maximize profits and make the business environmentally sustainable. The management of the organization achieve these goals through supply chain management has recently focused (Fawcett, et al. , 2007). Tesco is one of the World’s leading retailer with operations in United Kingdom, Korea, Poland, Czech Republic and Slovakia, Hungary, Malaysia, Japan, China and the United States.She became increasingly significant on the international stage. The supply chain transformation has underpinned to this retail success story. Tesco adopted a common operating model across its worldwide business, admitting it to spread and support key supply chain and replenishment applications when it expanded into new countries. Tesco leveraged a common model across multiple countries and strong willingness to acc ept local market without losing its core identity, this allowed Tesco think globally and act locally (Smith and Sparks 1993 and Gustafsson et al 2006).There were four main improving stages in distribution and supply chain strategies in Tesco that could be demonstrated; Direct to store delivery, centralization, composite distribution and vertical collaboration and ‘lean’ supply chains (Fernie & Sparks, 2009). Direct to store delivery (DSD): This process operated in mid-1970s. The direct delivery by the manufacturers and suppliers to the retail shops whenever they wanted. Shop manages operated in own interest. These made central control and standardization more difficult.A requirement of alternative in approach to supply and distribution occurred as the new corporate business strategy took hold (Fernie & Sparks, 2009). Centralization: This process was applied to move away from DSD in 1980. The introduction of centralization compelled suppliers to meet Tesco’s opera tional demands and gave control over the supply of products to stores within a lead time of maximum of 48 hours. Suppliers were forced to deliver into the distribution centers of the supply network.This allowed faster stock turn, better lead time and reduced inventory cost. Moreover, the organized network of centralized distribution centers was linked by computer to stores and head offices. Buffer stock level and operations stock was reduced. However, this created problems of high logistic cost due to the increased delivery frequency, running of empty or un-full vehicle and increased labor cost on more frequent receiving. Nevertheless, outsourcing was the key component of the revised supply chain network.It allowed making comparison between Tesco’s operated centers and outside contractors, to measure the practices between two parties and drive efficiency (Fernie & Sparks, 2009). Composite Distribution: This integrated strategy of supply was implemented in 1990, in ongoing imp rovement process. It enabled chilled, fresh and frozen products to be distributed by multi-temperature warehouses and vehicles through a common system. Special designed vehicles with individual temperature control compartments were used to delivery any combination of these products.According to Fernie and Sparks (2009, pg. ,151), â€Å"The move to composite led to the further centralization of more product groups , the reduction of stock holding, faster product movement along the channel, better information sharing, the reduction of order lead times and stronger code control for critical products. This composite structure became the backbone of the supply network. † Tesco international business growth and the new methods of working, the composite nature of centers became regional distribution centers (RDC) gradually.Vertical Collaboration and â€Å"Lean† Supply Chains: Jones and Clarke (2002) stated that there were lots of chances for improvement even in the best-run v alue streams. A famous quoted example, Tesco cola can journey (Womack and Jones 2005). The can example demonstrated the improvement process undertaken by Tesco. Firstly, map of the traditional value stream. It enhanced the effectiveness and efficiency of the supply chain.According to Harrison and Hoek (2008), Information sharing technology enables collaborative partners working togeth er from product design, manufacturing, logistic flow, demand forecasting, replenishment planning and work closely to align their organization strategy in order to achieve competitive advantage. Kotler (1988) claimed that a company going abroad must study and understanding each foreign market carefully, being sensitive to its culture and economics, and apply adjustment in its products and communication to suit local needs.With support of the above authors, Tesco had made a remarkable supply chain operation in international expansion. Question 2: Different aspects concerning Tesco’s International experience are included in the indicated case study from page 30. You are required to select and evaluate three of these experiences. Various dimensions of Tesco’s international experience are illustrated in the case study. The following experiences are selected to be evaluated, they are entry mode experiences, marketing and communications and human capital experience.Entry mode experience: Expansion into foreign markets can be carried out via the four mechanisms; direct investment, acquisition, licensing and joint venture (Foley, 1999). The entry mode that Tesco chose to adopt when entering foreign market was acquisition (Yoruk & Radoservic, 2000). (Fig. 1) Compared to other large retail companies such as Wal-Mart who lean to focus on larger market, Tesco tended to take a more conservative entry strategy. Tesco entered the central European market through store-by-store mode. It allowed testing on the market with comparatively lower startup cost.The human and financial capital was also minimized. On the other hand, the cost of failure or replacing them by larger hypermarket was also lower. After a testing period of these acquisitions, Tesco started to expand through Greenfield investments. It constructed new hypermarkets in outskirt (Beckmann, 1999). This was a very aspiring change for Tesco since this was totally new. This approach allowed to have a exper ience on the expand which is completely apart from current domestic supermarket format and extend the international retail store operations.Marketing and communication: Tesco learned from accumulated experiences in approaching new markets, compared to the failure experience in entering the Ireland and French markets, Tesco made success in entering Czech Republic because of its vigorous initiative to adopt the local market without drooping its core identity which were offered low prices, high quality product and services. Take care when using the word over before a sequence of numbers that might be confused for a figure, as in â€Å"The Ohio city will settle a lawsuit over 911 calls,† which might mistakenly suggest to readers that one or more verbs have erroneously been omitted before a reference to more than a given number of calls, rather than that 911 refers to the phone number for reporting an emergency. The sentence is easily revised to â€Å"The Ohio city will settle a lawsuit regarding 911 calls.† Also, two numbers in numeral form should not appear in sequence, as in this example in which an age is followed by a count: â€Å"The day the slain woman was to turn 28, 3,000 people gathered at a church to recall her life.† The proximity of 28 and 3,000 with an intervening comma suggests that the number 283,000, or a similarly appearing figure, has been incorrectly rendered. (Readers will not make that assumption, but the initial confusion is distracting.) If a publication’s style requires ages to be given in numerals, spell out the attendance count, an acceptable treatment of a large round number. Marketing: Strategic Innovation in Globally Diverse Markets Essay

Personalized marketing (sometimes referred to as one-to-one marketing) is the marketer attempt to provide the customer individual attention through a variation of methods. Personalized marketing is a strategic approach which involves tailoring products differently for each and every consumer while retaining the principles of mass production. One-to-one marketing is attributable to two converging phenomena: the interactive flow of information made possible by robots and just-in-time inventory (Lampel & Mintzer, 1996, p. 1). In order for a company to be effective in personalized marketing, the company must be able to gather information on the target individual. Today, with the power of technology this is a widespread practice on the Internet. The Internet provides a medium to make one-on-one personalization practical for a variety of firms (Schibsted, 2001). For example, a web page may establish cookies and track the buying habits of the customer. Based on the customer buying habits, advertisements are geared towards that individual. An example of personalized marketing is something I witness on a regular bases, but did not realize it was referred to as personalized marketing. I consistently purchase items through Amazon. com, in which I typically purchase books. Amazon. com routinely sends me emails, informing me of sales or populates my home page with advertisements relating to certain categories of books I typically purchase. As pointed out by Vesanen, (2007), developments in information and communication technologies have opened up new opportunities to collect and analyze data and implement personalized marketing (p. 09). In today’s market there is an increase in customer satisfaction. In order for businesses to succeed and be competitive they must be in tune to the customer needs and wants. Marketing to the individual customer can be profitable to the company as long as the method of gathering the data and establishing personalization is not complex. As studied by Goldsmith & Frieden (2004), data warehouses allow companies to store trillions of bytes of consumer information. Computer controlled factory equipment , and industrial robots can quickly readjust assembly lines. Bar code scanners make it possible to track parts and products. The Internet ties it all together and makes it easy for a company to interact with customers, learn about their preferences, and respond. Personalize marketing can benefit some companies; however it would be much more difficult for a store to personalized catalogs, pamphlets, or fliers for each of its customers, by proposing deals, rebates and reductions based on the customers shopping habits. Not only would it be difficult, but it would not be cost effective for a company to engage in this type of personalization. Personalization can take many forms, from the customization of Web sites to the customization of products. Whatever the extent of it, it is an expensive and time-consuming activity. While Amazon is the leader in this type of customization, few others are succeeding (Goldsmith & Frieden). Dynamic Pricing Dynamic pricing is broadly defined as the buying and selling of goods and services in markets where prices are free to adjust in response to supply and demand conditions at the individual transaction level (Garbarino & Lee, 2003, p. 495). From a business point of view, dynamic pricing is a profitable concept in personalized marketing. For example, a customer may go to a car dealer and do not see the car they would like on the lot. Therefore, a car is ordered with exact specifications and because of the specialty requirements the price of the car increases, making the transaction profitable for the business. Dynamic pricing enables the business to increase the price on an item; strengthen customers’ allegiance, along with enhancing customer satisfaction. Carroll & Coastes (1999) state that economics define price discrimination as the practice of charging multiple prices for the same good where the difference in price is based on a difference in demand rather than cost. There are three degrees of pricing models commonly used in the retail marketplace: * First-degree price discrimination – different prices are charged based on what the buyer is willing to pay * Second-degree price discrimination – offers a variety of pricing options * Third-degree price discrimination – market-segmentation pricing (Garbarino & Lee, p. 498). From a business stand point, first-degree price discrimination is more profitable because it obtains the maximum value of the item. However, from a consumer stand point second-degree price discrimination can offer more value to the customer. It allows customers to choose the pricing option that will work for them, based on their desires and requirements. Online Retailers versus Offline Retailers The materialization of online retailers is compelling retailers to reassess their business practices and the use of technology. Integrating online and offline channels are very much on the minds of retailers, and it is forcing them to understand how to manage relationships across multiple channels. Retailers need to understand who their customers are, understand their behavior, and execute seamlessly across those channels (Beasty, 2006). Online retailing is the fastest growing channel in which consumers purchase products. Integrating online retailing with offline retailing comes with numerous problems. The consumer may see a product in the store for one price and see that same item online at a different price. Retailers compete nationally and locally on prices and products. Someone in Florida may not want to purchase the same products as someone in Washington D. C. or you may have a retailer located in California, but the company’s web site can be accessed by anyone that can utilize the web. According to study by Beasty, (2006), you mainly see this problem when consumer purchasing is based primarily on price. For example, a PlayStation is a PlayStation no matter where you purchase it, but saving $20 makes a big difference to customers. Another example is a few years ago Circuit City gave one price online, another price in their ad, and a different price in the store, all for the same item, without any explanation as to why (para. 6). This leaves the consumer frustrated, confused and a lack of understanding. Francis, (2007) studies states that one size does not fit all in the Internet retailing marketplace. The author categorized Internet retailing as follows: * Offline goods – items such as, books, groceries, and CDs are purchased and the consumer disengage from the web site and wait for their order to be delivered * Offline services – consumer pay for or book services, such as, travel, event tickets, and hotels online than travel to an offline service deliver location * Electronic-goods – the consumer purchase and download their products, such as software, MP3s, and digital books directly from a website; and * Electronic Services – the consumer purchase, co-produce, and consume the core service, such as banking, brokerage, chat/dating services via a web site. Online retailers must recognize the difference variations in online shopping and ensure customers’ requirements are effectively and properly addressed. Traditional methods of advertising include billboards, TV commercials, radio ads and posters. Companies still use the traditional methods of advertising , but they use the Internet to their advantage by incorporating new advertising with traditional advertising. The habits of today’s consumer dictate the method of advertising for a company to stay competitive. The invention of the TV digital video recorders (DVRs) and the consumer fast-forwarding through commercials makes TV advertising less effective in today’s marketplace. To remain relevant and competitive companies have a multitude of different formats of online advertising, such as banner ads, pop-up ads, floating ads, streaming sidebar ads, pull banner ads, and text ads, just to name a few. In addition, many companies ask you to â€Å"like† their link, in which the company’s page is now on your Facebook or Twitter page. This enables Facebook or Twitter to determine your shopping habits, and you can visit a company’s site right from you social media page. Offline stores has responded to the competition of online retailers by sending out a variety of advertisements, such as direct-mail flyers, catalogs, television, via mobile phones, and the Internet. In addition, offline stores have responded by increasing their presence on the web as well as creating appealing experience within the offline store. Today, many offline stores are dominating the online market with their presence. Even though, online shoppers experience a delay in receiving their product, online stores are continuously improving the delivery turnaround time. In addition, most online stores do not charge taxes, include free shipping, and offer free returns or exchanges. However, some online companies may charge a low-price for an item, but compensate by charging higher prices for shipping and handling. Nevertheless, most online stores are growing faster than offline store. The expansion of the Internet has increased the variety of pricing models available, for example: * Per-user model – involves either a flat fee per user or a tiered fee structure based on the level of use * Per-transaction model – a rate structure is developed to account for different automated processes or functions * Percentage-of-revenue model – is like the per-transaction model in that the monthly fee will fluctuate as the level of activity changes; it differs, however, in that the model is tied to the amount of revenue the user generates each month * Fixed-fee model – a lump-sum monthly fee that covers products and services specified in the contract. Fixed-fee pricing models typically appeal to organizations that want costs to be predictable (Turisco, 2000). The online retailer has to determine which pricing model fits their needs and which pricing model will benefit the company financially and satisfy the consumer. In addition, the company must also consider their overhead and their anticipated growth. Globalization Influence and Marketing Trends Even though, globalization has brought benefits between nations, it has also brought universal problems between nations. According to Kearney, (2003), â€Å"September 11 was a gruesome vindication of the argument that global integration had widened the gap between the haves and have-nots†. The author further argues â€Å"that the persistence of al Quada underscores how hard it is for governments to stamp out stateless, decentralized networks that move freely, quickly, and stealthily across national borders to engage in terror†. Marketers need to recognize the pros and cons of globalization, utilize the benefits, and do not become submerse with complex situations that come with globalization. Authors Reddy & Vyas (2004) reviewed 10 pros and cons associated with globalization from a marketing perspective. The pros included: economic growth, rapid technology transfer, more countries becoming democracies, the rapid spread of free enterprise system, unification of culture, living norms, and work ethic, increased communication through the Internet and other media, instant news worldwide, worldwide improvement of health and living conditions, people living longer, and multinational corporations. The cons included: increased unemployment in developed countries, increased trade deficit in developed countries, terrorism, loss of competitiveness in developed nations, poorer nations feel taken advantage of by advanced nations, increased economic gap between the rich and poor nations, some countries feel their norms and religious practices are violated, comparisons with rich nations make poorer nations unhappy, increased pollution through manufacturing and transport worldwide, the spread of Aids, West Nile virus, and various kinds of flu and other diseases. Globalization is regarded with much criticism, however, globalization will continue. There may be some containment of rapidity because of tightening of the borders, demands for intellectual property protection, setting up firewalls for Internet communication, but the movement continues (Reddy & Vyas, 2004, p. 169). Firms and governments that are aware of the positives and negatives involved with globalization will be able to develop a better approach towards globalization. Influence of Online Today’s technology has changed communication and the way marketers get their message out to the consumer. The rapid diffusion of multipurpose smart phones, broadband and wireless Internet connections, and ad-skipping DVRs have eroded the effectiveness of the mass media (Kotler & Keller, 2012, p. 476). Marketers were able to reach consumers via three television channels 80% of the time in the 60s. Today, marketers would have to run the same information on at least 100 channels to get the same results. Marketers are using technology to reach a broader audience, but at the same time consumers are using technology to fight back. Consumers feel they are receiving numerous ads that have no bearing on their lives. Internet users are taking advantage of new software to block spam and pop-up ads (Nunes & Merrihue, 2007) and telemarketers are being stopped by caller ID and the â€Å"Do not call registry† to prevent disruptions at home. Marketers are answering back by applying alternative solutions. Per Nunes & Merrihue (2007), there are four strategies available to companies that want to reach broad groups of people without breaking their marketing budget. * Bottlenecks – places where people cannot help being stopped, such as subway, elevators, airplanes, or bathroom * Trojan horse approach – placing advertisements on frequently encountered materials, such as coffee cups and pay stubs * Get the attention of consumers at play outside their homes – placing advertisements on adult play thing, such as a golf cart * Extends the third strategy – seeks to get people to play along, using interactive technology in public spaces (p. 64). These types of tactics can target a broad range of consumers with various forms of advertisement that cannot be turned off. The Internet has affected retailers approach to advertising and promoting their products or services. It is vital for companies to develop an effective brand to gain competitive advantage in the marketplace. The Internet opens up opportunity for the consumer to provide feedback regarding products and services, which has a significant impact on the retailer, whether the feedback is positive or negative. The Internet also allows the retailer to be more creative based on feedback from the consumer in a number of online communities. The communication channels to the consumer have expanded in number as well as complexity with the global expansion of the Internet and related information technology based products and services. Information technology has dramatically changed how consumers process (or avoid) information delivered by marketing professionals and has eroded the effectiveness of media advertising. The reason for this erosion is due to fragmentation of retail audiences caused by the introduction enhanced media sources such as cable television, blogs, video-on-demand, webcasting, video games, websites, digital video recorders, and multi-functional communication devices (cell phones). The result of these technological and media advancements creates a shift in bargaining power give consumers choices about how, when, and where they consume information (SCH Management Consultants, 2011). The evolution of the Internet has altered the way the consumer and the marketer relate to one another and also how the consumer purchase products and services. The consumer today is more educated, more income at their disposal, and have multiple ways to obtain information; therefore the Internet cannot be disregarded by the retailer. According to SCH Management Consultants, (2011) retailers seeking to expand their brand into the online environment will need to invest in the online experience, as part of a multichannel strategy, to reinforce and complement the in-store experience. For example, if customer service is a key differentiator in a retail store, then the experience should be replicated by providing interactive help, rich media (video) demonstrations, and product comparisons. Consumers will demand the ability to order online and retrieve/return the product at the supplier’s storefront or other distribution points. The retailer that understands the art of engaging with the customer via the Internet has a better chance of appropriately marketing their products to the consumer and establishing a lasting relationship.
